Implementing the firmware was outsourced to Kinpo, so HP only had the specs book. I think that reason was named, but it cannot be the whole truth. The 35s software stems from the 33s, even shares some bugs. But there was an update to the 33s, both hard- and software, and the huge evolution to what the 35s became.

I see no reason why Kinpo shouldn't have been able to debug the code. First and most bugs were found in the first few months after the machine came out.
